These Terms govern your access to and use of the Vitals HQ website monitoring and maintenance platform (the "Service"). By creating an account or using the Service, you agree to these Terms.
The service
Vitals HQ provides uptime, SSL, domain, performance and platform (WordPress and Shopify) monitoring, along with maintenance tools, client portals, status pages, reporting, ticketing and optional AI-assisted features. Features vary by plan and may change as we improve the product.
Eligibility & accounts
You must be able to form a binding contract to use the Service. You are responsible for your account, your team members' access, and keeping credentials secure. Tell us promptly about any unauthorized use.
Acceptable use
- Monitor and manage only websites you own or are authorized to manage.
- Provide connection credentials (for example WordPress or Shopify tokens) only for properties you control.
- Do not use the Service to attack, overload, probe or gain unauthorized access to any system, or in any unlawful way.
- Do not resell, reverse-engineer or misuse the Service, or interfere with its operation.
We run automated checks against the URLs you add; by adding a site you confirm you are permitted to have it monitored.
Your content and clients
You retain ownership of the data you put into the Service — sites, client records, tickets and content. You are responsible for having the right to store it and for how you use client data, and you grant us the limited rights needed to operate the Service for you.
Third-party integrations
The Service connects to third parties such as the WordPress companion plugin, Shopify, email delivery, Google APIs, Stripe, and your chosen AI provider. Your use of those integrations may be subject to their own terms, and AI usage under your own key is billed to your provider account.
Plans, billing & cancellation
Paid plans are billed in advance on a recurring basis where applicable. You can change or cancel your plan at any time; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.
Availability
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation, and monitoring results are provided on a best-effort basis.
Disclaimers & limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for losses arising from missed alerts, downtime or reliance on monitoring results; our total liability is limited to the amount you paid for the Service in the twelve months before the claim.
Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to protect the Service or other users.
Changes
We may update these Terms; the "Last updated" date above reflects the latest version. Continued use after a change means you accept it.
